Valid Government-Issued Identification:

Clients must present a valid form of identification at the time of notarization.

Acceptable IDs may vary by state. However, for California, are:

A: You are required to provide a current or issued within five years CA-approved Identification and can be any of the following: 

1. ID card or Driver's license issued by the California DMV; 
2. U.S. Passport; 
3. An inmate ID card issued by the California Department of Corrections and Rehabilitation (if the inmate is in custody in California state prison); 
4. An inmate ID issued by a sheriff's department (if the inmate is in custody in a local detention facility); 


B: The following forms of identification listed below must contain a photograph, physical description, signature, and serial number:*
1. A valid consular ID or passport issued by a foreign government;* 
2. ID card or Driver's license issued by another U.S. state;*  
3. A driver's license issued by an authorized Canadian or Mexican public agency;* 
4. U.S. military ID card;*
5. Employee ID card issued by an agency or office of the State of California or by an agency or office of a  CA city, county, or city and county;*  
6. ID card issued by a federally recognized tribal government.*

Correct Spelling of Names

Ensure the names on the document match the names on the ID.

  • The notary may not be able to notarize the document if the identity cannot be verified

 

Tip: All parties being notarized  sign exactly as their name appears on the document and ID.

Unsigned Documents

Do not sign the document in advance unless it’s:​

  • For an acknowledgment, signing before meeting is generally acceptable

  • For a jurat, the signer must sign in front of the notary

🖊️ When in doubt, wait to sign in front of the notary.

Correct Notarial Certificate

Check if the document already includes a notarial certificate. If not, the notary may assist in finding the correct one based on the client’s request, rather than the notary’s discretion.

Common types:

  • Acknowledgment: Signer confirms they voluntarily signed the document

  • Jurat: Signer swears or affirms the contents are true, and signs in front of the notary

📌 If unsure, the notary can explain both types and let the signer choose.
⚖️ Notaries are not allowed to decide which one to use without client direction.

All Signers Must Be Present

Every person who needs to sign and be notarized must be physically present at the appointment with valid ID.

Document Must Be Complete

The document must:

  • Have no blank spaces that could be filled in later

  • Be entirely legible and complete

  • Not be missing pages

❌ Notaries cannot notarize incomplete documents.

Understand What You're Signing

All signers must:

  • Be aware of what they are signing

  • Be able to communicate clearly (in English or with a qualified translator present)

  • Not be under duress

⚠️ If the signer appears confused or pressured, the notary must decline the notarization.

 Witnesses (if required)

Some legal documents (like wills or deeds) may require additional witnesses.

If witnesses are needed:

  • Not all notaries provide them—ask in advance

  • Witnesses cannot be family members or named in the document

  • The document printed if it was received digitally
